Clear expectations, fair terms, and straightforward agreements. Know what you're signing up for.

1. Service Description

Kustom Kinections provides AI implementation and management consulting services to businesses. Our services include:

  • AI Consulting: Strategic planning and implementation guidance
  • System Building: Custom AI workflow development and automation
  • Social Media Management: AI-powered content creation and posting
  • Website Design: Modern, conversion-focused web design
  • Workshops: Educational sessions on AI tools and business applications

All services are provided according to the scope defined in individual project agreements or service descriptions on our website.

2. Acceptance of Terms

By engaging our services, booking a consultation, or purchasing a workshop ticket, you agree to these terms. If you don't agree with any part of these terms, don't use our services.

These terms apply to all services, whether delivered virtually or in-person, and supersede any conflicting terms in other communications unless specifically amended in writing.

3. Payment Terms

Workshop Payments:

  • Full payment required at time of booking via Stripe
  • Pricing as listed on the website at time of purchase
  • All payments in USD

Consulting & Project Payments:

  • Pricing and payment schedules as outlined in individual project agreements
  • Monthly retainer services billed at the beginning of each service period
  • Project-based services may require deposits or milestone payments
  • All payments processed securely through Stripe
  • Late payments may result in service suspension after 15 days

4. Refund Policy

Discovery Call Guarantee:

After our initial discovery call, if we determine that we're not a good fit for your needs, we'll issue a full refund. No questions asked. We'd rather be honest upfront than waste your time or money.

Workshop Refunds:

  • Full refund available if you cancel at least 24 hours before the session
  • Can transfer your ticket to a future date instead of refunding
  • No refunds for no-shows without 24-hour notice

Project Work:

Once project work begins (after the discovery call and agreement), refunds are not available. Scope changes or project termination will be handled according to individual project agreements.

5. Intellectual Property

Client Deliverables:

You own the final deliverables we create for your business — websites, automation workflows, content, and strategic documents. Upon full payment, all rights transfer to you.

Portfolio Rights:

We retain the right to showcase our work in our portfolio and marketing materials, with your permission. We'll never share proprietary business information or competitive details.

Pre-existing Materials:

Any methodologies, frameworks, or tools we bring to your project remain our intellectual property. You get a license to use them for your business, but can't resell or redistribute them.

6. Limitation of Liability

We're good at what we do, but we're not magicians. Our liability is limited to the amount you paid for services. We're not responsible for:

  • Lost profits or business opportunities
  • Data loss (though we'll help you implement good backup practices)
  • Third-party platform changes that break integrations
  • Results that depend on your execution and follow-through
  • Force majeure events beyond our control

We'll work with you to solve problems, but some things are outside our control. We'll be transparent about what those are.

7. Third-Party Services

Our services often involve integrating with third-party platforms and tools. We're not responsible for:

  • Changes to third-party APIs or pricing
  • Platform outages or performance issues
  • Policy changes that affect functionality
  • Account suspensions due to platform policy violations

We'll help you navigate these issues when they arise, but the ultimate relationship is between you and those platforms.

8. Service Termination

By You:

You can terminate ongoing services with 30 days' written notice. You're responsible for payment through the end of the notice period. Project work in progress will be completed or stopped according to individual agreements.

By Us:

We reserve the right to terminate services if:

  • Payment terms are not met
  • You ask us to do something unethical or illegal
  • Communication becomes abusive or unprofessional
  • You repeatedly ignore our recommendations and then blame us for results

We'll give reasonable notice and try to resolve issues before terminating.

9. Confidentiality

We treat your business information as confidential. We won't share your strategies, data, or proprietary information with competitors or other parties, except as required by law.

You agree to keep our methodologies and proprietary processes confidential as well.

This confidentiality survives the termination of our working relationship.

10. Communication

We'll communicate primarily through email and scheduled calls/meetings. Response times:

  • Email inquiries: Within 1 business day
  • Project updates: Weekly or as agreed in project scope
  • Urgent issues: Same day when possible

We don't monitor email 24/7. True emergencies should be defined upfront, and emergency contact procedures established if needed.

11. Governing Law

These terms are governed by Pennsylvania law. Any disputes will be resolved in the courts of Pennsylvania.

However, we'd rather solve problems through direct communication than lawyers. Most issues can be resolved with honest conversation.

12. Dispute Resolution

If we have a disagreement:

  1. Talk it out: Direct communication first — most issues resolve here
  2. Mediation: If needed, we'll try mediation through a neutral third party
  3. Legal action: Only as a last resort, and subject to Pennsylvania jurisdiction

We're reasonable people building long-term relationships, not looking for fights.

13. Changes to Terms

We may update these terms occasionally. If changes are significant, we'll notify active clients by email at least 30 days before changes take effect.

Continued use of services after changes indicates acceptance. If you don't agree with updated terms, you can terminate services according to the termination clause above.

For project-based work, terms in effect at the start of the project apply throughout that project.
